General Lee and SCOTUS Decisions
Today, Warner Brothers announced that they would no longer market the General Lee car toy from the Dukes of Hazard TV show. Governor Haley (R-SC) announced that she would work with the state legislature to change the law to remove the Stars and Bars from the state capital. By the way, just for informational purposes, the legislation mandating the flying of the Confederate Flag was signed into law by Ernest "Fritz" Hollings (D-SC). That isn't any surprise, because as anyone knows who reads history instead of being taught it, that it was the Democratic Party that supported slavery, segregation, Jim Crow Laws, Poll taxes, and I could go on. (and filibustering the Civil Rights act of 1964). That is a state's decision, just as it is a corporate decision to remove Confederate Flag memorabilia from shelves. (Walmart, WB, Ebay, and undoubtedly more) By the way, on Ebay as of this writing, you can find memorabilia from the DNC 1992 Bill Clinton/Al Gore campaign gear with the rebel flag, as well as memorabilia from a much more recent campaign by a current candidate (2008) with the same flag. Any guesses as to which party, or to which candidate I am referring? Hmmmm. (HRC)
The bottom line is that to blame a flag for hate is insane. The war of northern aggression is over. The South lost. Shame that if we fought wars today like that one was fought, there would be no ISIS, no palestinian conflict, and Iran would be the minor player on the world stage that it used to be. If politicians were as good as accepting blame as assigning it, our government would probably be much smaller, far more efficient, and we would be free to pursue our lives as we wanted. Fourteen million current and former federal employees have their identities compromised because of shoddy protections at the OPM and no one is fired, or even disciplined. Confidential tax filings are publicized during a political campaign, no one is fired, and the person who could answer, and should have, has been allowed to retire, thus out of reach of investigators. The first ambassador since the hostage crisis in Iran to be murdered, and the state department intentionally lies to the world on the why. How is the VA doing? That is a true disgrace, and every American should be outraged at the treatment of these soldiers.
In the next week, two blockbuster cases will be announced by the Supreme Court. King v Burwell, regarding the arbitrary allowing of subsidies on NON state built exchanges. The other case led by Obergefell v Ohio, could create a right that hasn't previously existed in regards to who may marry whom, or it could throw into legal limbo the status of gay marriages throughout the country.
The King case I think will go with the actual wording of the law. Which is to say that the subsidies will be gone, and then someone will have to work together to get it fixed, or maybe repealed. (repeal won't happen with the current occupant, but since they already Executive Ordered the loose interpretation, a Plan B will be required.) In fact, some of the record indicates that this breech may have been intentional to force the collapse of private insurance, bringing on the Federal Government to save the day. Who is up for VA style health care for all?
The Obergefell decision is a toss. I have written on this many times. Justices Kennedy and Breyer were fairly harsh on the plaintiff, Asking about having 9 people overturning millenia of tradition, and what scientists have consistently proven the ideal family of having a father and a mother. Having said that, I don't think Breyer is even in the mix, thus allowing a single judge, not nine, decide. Justice Kennedy has often written opinions supportive of the gay agenda, He also authored the opinion in 2013, which seemingly unknown to the world, stated that states should decide the definition of marriage. If one bases their bets on that, then there would be no choice but to throw out all the stays, overturnings, and controversially marriages forced on unwilling states. I think that Kennedy is too fond of being accepted in social circles to support his 2013 decision and will vote to create out of whole cloth a right to be married.
It will be fun.
