A suggestion for the President.
Mr. President.
As you consider your nomination for a replacement for one of the three upholders of their oaths on the Supreme Court bench, let me give you a suggestion that could wipe out your enemies, at minimal cost to you or your party. (no seriously)
I would suggest Senator Ted Cruz (R-TX). I know, he believes in the Constitution, you believe in the court making up the constitution out of whole cloth. Let me suggest why;
The one thing you wouldn't like was just listed. Why do it? Well, for one, it wouldn't change the make up of the court. One for one. Kind of like you felt when Justices Alito and Roberts were nominated, and you filibustered. What is in it for you?
Think about the contention in the GOP nomination process. Right now, there is Trump, and the Establishment, and the Conservative. You pull the conservative, and I suspect you hand the election to the Democrat. The establishment will fall in line, probably behind Rubio. If the fix appears to be in, Trump bolts. His voters will never support the Republican nominee, unless it is Trump. Conservatives will not support Trump, and probably wouldn't support an establishment nominee. See? Not enough, how about this?
Think about what a Cruz nomination would do to the Senate. On one hand, you would have those glad to get rid of him. It would be a great day for the establishment in the Senate with him gone, and think of the goodwill you would earn. Justices Ginsburg, Souter, or Kennedy could retire, and you could point out your goodwill pick of Cruz, and point out that you are replacing a hard core leftist with a hard core leftist. One for one. As to Kennedy, well, he is not hard core anything, with the possible exception of being popular in DC. If they allowed a Cruz nomination to go through, how could they stand against you on a Ginsburg appointment? Unless....
Your party fights Cruz, and grabs enough wishy washy Republicans with them to fight the nomination. Again, think about the destruction that would cause the GOP with its base. They feel that as long as they have the donor class, they can buy their way out of any problems. They are hanging on to their rank and file by a thread. A loss on a Cruz would be it.
I really am looking out for you. Such small cost, and such potentially high reward.
